TERMS OF SERVICE (TOS)
The following conditions apply to all contracts, deliveries and services between Barta Jeans GmbH and its private customers.
Conclusion Of A Contract
The contract is legally concluded when the goods are sent. Should you lose your documents for your orders, please contact us by email / fax / phone. We will be happy to send you a copy of the details of your order. The contract is concluded exclusively in German and English.
- Cancellation Policy
Right of cancellation You have the right to cancel your contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods. In order to exercise your right of withdrawal, you must contact us.

By means of a clear declaration of your decision to withdraw from this contract. You can use the attached cancellation form * for this, but this is not mandatory. * A return slip including a return sticker is enclosed with our goods. This return slip is a cancellation form! The cancellation form, which is available both for download and for filling out online, does NOT have to be filled out additionally. In the event of a return, we ask you to keep the return receipt from Swiss Post with the ID code listed on it for at least 6 months. This receipt serves as proof that your return has been submitted to the post office. You can also electronically fill out and submit the cancellation form or another clear declaration on our website. If you make use of this option, we will send you a confirmation of receipt of such a cancellation immediately (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired. Consequences of revocation If you revoke this contract, we will have you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you use a different type of delivery than the one we offer, have chosen the cheapest standard delivery), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier. You have to send the goods back to us immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We bear the costs of returning the goods within Germany and Austria. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
- Material Defects
The statutory warranty provisions apply. The warranty period is 2 years and begins with the conclusion of the contract. Your warranty claims are initially limited to subsequent performance. If the supplementary performance fails, you can choose to withdraw from the contract or to reduce the purchase price. Please check the integrity of your package. Damage or partial loss must be reported to the shipping company in writing within 7 days of delivery.
- Delivery Time
We deliver in the shortest possible time. If an article is out of stock, we will send you a first partial shipment within 10 to 14 days and notify you of the expected further delivery date. If you use our immediate service (shipping costs increase by € 2.00), the shipment will be made within one working day after receipt of the order. The prerequisite is that we have received the order by 2 p.m. and that the items ordered are in stock. In the event of delivery delays, we will inform you immediately of the expected delivery date.
- Postage And Packaging Costs
The postage and packaging costs within Germany are EUR 5.50 per order. In the case of partial deliveries, this amount will only be invoiced once for the first delivery. In the case of cash on delivery, the postage and packaging costs are EUR 11.10. As part of a "order postage-free" campaign, postage and packaging costs are incurred in full when paying by cash on delivery. We charge an additional EUR 2.00 for the use of the instant service.
- Shipping Abroad
For shipments to other European countries, the following postage costs are charged per order: To Austria: 5.50 euros In member states of the EU (except Austria) and EFTA: 12.50 euros Worldwide: 30.00 euros In individual cases, however, we reserve the right to charge the costs to calculate according to the actual weight. Please ask. First orders are only delivered against prepayment. German VAT (currently 19%) is included in the invoice amount. Unfortunately, customs documents cannot be created. Return costs from abroad are generally to be borne by the customer. The parcel shipping prices of the post office of the respective country apply.
- Product Prices
he prices at the time of the order apply. The prices are valid until the publication of the new season catalog and include the value added tax of z. Currently 19%. The postage and packaging costs within Germany are EUR 5.50 per order. In the case of partial deliveries, this amount will only be invoiced once for the first delivery. We reserve the right to change product prices as an exception. Special promotions: You can find out the period of validity of our limited offers wherever they are displayed in the shop. Despite careful stocking, it can happen that a promotional item is sold out faster than expected. Therefore, we do not guarantee delivery. The following applies: "Only while stocks last."
- Terms Of Payment
Delivery is generally made against a transfer or payment option in the online system provided for this purpose. After entering the means of payment and receipt of the invoice, the goods will be delivered. Discount cannot be deducted.

- Retention Of Title
The delivered goods remain the property of Barta Jeans GmbH until they have been paid for in full.
